Software License Agreement (EULA)

This End User License Agreement (“EULA”) is a legal agreement between you and Orbit Info Tech (OiT), Muscat, Sultanate of Oman (“OiT”, “73PiXEL”, “we”, “us”, or “our”) governing your use of 73PiXEL software, including WordPress plugins, updates, documentation, and bundled digital materials (the “Software”). By installing, activating, copying, or using the Software, you accept this EULA.

1. License Grant

Subject to payment of applicable fees and continued compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software on the number and type of sites permitted by your purchased plan.

2. Open-Source Components

Some Software components may be distributed under the GNU General Public License or another open-source license. Those components are governed by their applicable open-source terms. Any proprietary assets, cloud services, license keys, trademarks, documentation, or other materials not covered by an open-source license remain subject to this EULA.

3. License Scope and Activations

Each activation must correspond to a legitimate site you own or manage for a client within your plan limit. Development, staging, or local installations may be treated separately where our licensing system supports that distinction. You must not share, resell, publish, or pool a license key, or use one license to provide unauthorized software-as-a-service access.

4. Restrictions

Except as allowed by mandatory law or an applicable open-source license, you must not:

  • circumvent, disable, or tamper with licensing, activation, security, or usage controls;
  • remove copyright, trademark, attribution, or proprietary notices;
  • redistribute proprietary builds, license keys, updates, or support access;
  • use the Software to violate law, infringe rights, distribute malware, or interfere with systems;
  • misrepresent the Software as your own product or use our marks without permission; or
  • use the Software beyond the site, user, or term limits of your plan.

5. Ownership

The Software is licensed, not sold. We and our licensors retain all rights, title, and interest not expressly granted to you. “73PiXEL” and associated names, logos, and product branding are owned by Orbit Info Tech or its licensors.

6. Updates, Support, and Services

Access to updates, downloads, cloud features, and support depends on your plan and may require an active subscription and valid license. We may modify or discontinue non-essential features prospectively, but will not knowingly remove paid core functionality during a current term without a reasonable remedy where required.

7. Data and Connectivity

License activation, update delivery, security, support, and optional telemetry may require communication with 73PiXEL, Freemius, WordPress, or related service providers. Personal data is handled according to our Privacy Policy. You are responsible for obtaining any notices or consents required for your own site and users.

8. Customer Responsibilities

You are responsible for backups, secure credentials, testing in a non-production environment when appropriate, maintaining compatible WordPress/PHP versions, and verifying the Software’s suitability for your intended use. You must not provide us with secrets, payment-card data, or unnecessary personal data in support requests.

9. Term and Termination

This EULA begins when you first install or use the Software. It ends when the license term expires, you permanently stop using and delete the Software, or we terminate it for material breach. We may suspend activations or services where reasonably necessary to address fraud, abuse, security risk, non-payment, or legal obligations. Upon termination, you must stop using proprietary portions of the Software and delete copies where legally permitted.

10. Warranty Disclaimer

To the maximum extent permitted by law, the Software is provided “as is” and “as available.” We do not warrant uninterrupted or error-free operation, compatibility with every theme, plugin, host, browser, or future platform version, or fitness for every purpose. Mandatory warranties that cannot be excluded remain unaffected.

11. Limitation of Liability

To the maximum extent permitted by law, Orbit Info Tech will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, revenue, data, goodwill, or business interruption. Our aggregate liability arising from the Software will not exceed the amount you paid for the affected Software during the twelve (12) months before the event giving rise to the claim. These limits do not apply where prohibited by law.

12. Governing Law and Disputes

This EULA is governed by the laws of the Sultanate of Oman, without regard to conflict-of-law rules. Subject to mandatory consumer rights, the competent courts of Muscat, Oman have exclusive jurisdiction.

13. General

If any provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign this EULA without our prior written consent; we may assign it as part of a merger, reorganization, or transfer of the relevant business. This EULA, the Terms of Service, Privacy Policy, and purchase terms form the entire agreement for the Software.
