These Terms of Service (“Terms”) govern access to 73pixel.com, related customer and support portals, documentation, downloads, and software products offered under the 73PiXEL brand (collectively, the “Services”). The Services are operated by Orbit Info Tech (OiT), Muscat, Sultanate of Oman (“OiT”, “73PiXEL”, “we”, “us”, or “our”).
By accessing the Services, creating an account, purchasing a license, downloading a product, or using our software, you agree to these Terms. If you act for an organization, you confirm that you have authority to bind it.
1. Eligibility and Accounts
You must have legal capacity to enter into a binding contract. You are responsible for accurate account information, safeguarding credentials, and activity under your account. Notify us promptly at info@73pixel.com of suspected unauthorized access.
2. Products and Services
73PiXEL develops and licenses WordPress plugins and related digital products. Product descriptions, features, compatibility requirements, license limits, billing cycles, and prices shown at purchase form part of your order. We may improve, modify, replace, or discontinue features, provided that we do not materially remove paid core functionality during a prepaid subscription term without an appropriate remedy.
3. Orders, Payments, and Taxes
Payments, invoicing, applicable taxes, subscription administration, license delivery, and certain customer-account functions are processed through Freemius, which acts as the merchant of record and reseller for applicable transactions. Purchases are also subject to the terms and privacy notices presented in the Freemius checkout. We do not directly receive or store complete payment-card details.
Prices may be displayed in different currencies and may exclude taxes until checkout. Taxes, currency conversion, and payment-method charges are determined by Freemius and the relevant payment provider.
4. Subscriptions, Renewals, and Cancellation
Unless stated otherwise at checkout, subscriptions renew automatically for the selected billing period using the payment method on file. You may cancel future renewal through the Freemius customer portal at any time before the renewal date. Cancellation stops future charges but does not retroactively refund the current term. Access to updates, downloads, premium features, and support may end when the paid term expires.
We may change renewal pricing for future terms after reasonable notice where required. The price applicable to a completed order will not be changed retroactively.
5. Software License
Your use of a product is governed by the applicable Software License Agreement and any open-source license included with that product. License activation limits are determined by the plan purchased. A license key may not be shared, resold, pooled, or used to exceed the permitted number of sites.
Open-source components remain governed by their respective licenses. A commercial license key primarily controls access to premium downloads, updates, support, hosted services, and other plan benefits; it does not override rights granted by an applicable open-source license.
6. Updates and Compatibility
An active subscription generally includes updates made available for the licensed product. We aim to support currently maintained versions of WordPress, WooCommerce where relevant, PHP, and listed integrations. We cannot guarantee compatibility with every theme, plugin, host, custom codebase, beta release, or unsupported platform version.
7. Support
Technical support is provided according to our Support Policy and the purchased plan. Support does not include custom development, site administration, data entry, third-party product support, server management, or recovery from changes made without appropriate backups unless expressly agreed in writing.
8. Refunds
Refund eligibility is governed by our Refund and Cancellation Policy and the refund terms shown at checkout. Our standard policy is a 30-day Satisfaction Guarantee requiring reasonable cooperation with our support team. Nothing in these Terms limits non-waivable consumer rights under applicable law.
9. Acceptable Use
You must not use the Services to violate law, infringe intellectual-property or privacy rights, distribute malware, send spam, interfere with systems, bypass security or licensing controls, probe systems without authorization, upload harmful content, impersonate others, or facilitate fraud or abuse. Additional rules appear in our Acceptable Use Policy.
10. Customer Content and Backups
You retain ownership of content and data you submit. You grant us a limited right to process that content only as necessary to provide, secure, support, and improve the Services or comply with law. You remain responsible for lawful collection of data, permissions, configuration, and maintaining current backups before installing, updating, or troubleshooting software.
11. Intellectual Property
The 73PiXEL name, logos, documentation, website design, non-open-source assets, product names, and other proprietary materials are owned by Orbit Info Tech or its licensors. Except for rights expressly granted under these Terms or an applicable software license, no rights are transferred to you.
12. Third-Party Services
Products may integrate with WordPress, WooCommerce, Freemius, hosting providers, messaging platforms, payment services, or other third parties. Their services are governed by their own terms. We are not responsible for third-party outages, changes, pricing, security, policies, or discontinued APIs, though we will use reasonable efforts to maintain supported integrations.
13. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available”. We do not warrant uninterrupted or error-free operation, universal compatibility, or that a product will meet requirements not stated in its documentation. No advice or information creates a warranty not expressly stated in writing.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Orbit Info Tech will not be liable for indirect, incidental, special, punitive, or consequential loss; loss of profits, revenue, goodwill, data, or business opportunity; or costs arising from third-party products or failure to maintain backups. Our aggregate liability relating to a product or Service will not exceed the amount you paid for that product during the 12 months preceding the event giving rise to the claim. These limits do not apply where liability cannot legally be excluded or limited.
15. Indemnity
To the extent permitted by law, you agree to indemnify Orbit Info Tech against third-party claims arising from your unlawful use of the Services, violation of these Terms, infringement of rights, or content you submit, except to the extent caused by our breach or misconduct.
16. Suspension and Termination
We may suspend or terminate access where reasonably necessary to address non-payment, security threats, fraud, unlawful activity, material breach, or risk to users or systems. Where practicable, we will provide notice and an opportunity to remedy the issue. Provisions intended to survive termination will remain effective.
17. Changes to These Terms
We may update these Terms to reflect legal, technical, or business changes. The updated date will be shown above. Material changes will be communicated where reasonably required. Continued use after the effective date constitutes acceptance, except where additional consent is required by law.
18. Governing Law and Disputes
These Terms are governed by the laws of the Sultanate of Oman, without regard to conflict-of-law rules. The competent courts of Muscat, Sultanate of Oman, have jurisdiction, subject to any mandatory consumer forum or rights that cannot be waived. Before filing a claim, the parties should attempt in good faith to resolve the dispute by written notice.
